Non-Class, Non-Complex, and Two-Party (Singe Plaintiff v. Single Defendant) Mediation Rates

 

Full day mediation, $10,000.  This includes all prep time, time on the day of mediation, and post mediation follow-up. Additional sessions, $7,000 per day.

Half-day (4-hour) sessions are available and will be billed at a fixed fee rate of 60% of the fee for a full day session.  This assumes that the complexity of the matter is appropriate for a half-day session. 

 

Complex, Class, and Representative Action Mediation Rates

 

Full day mediation, $15,000. This includes all prep time, time on the day of mediation (up to 10 hours), and post mediation follow-up. Additional sessions, $10,500 per day.

 

Half-day (4-hour) sessions are available and will be billed at a fixed fee rate of 60% of the fee for a full day session.  This assumes that the complexity of the matter is appropriate for a half-day session.  

 

 Logistics For All Mediation Types

 

Unless other arrangements are reached, mediations will be done remotely via a video platform such as Zoom.  Use of one of the parties' offices is preferred for in-person mediation, but other arrangements can be made for an additional fee. Travel outside of Los Angeles or San Francisco is available under special circumstances, for an additional fee plus reasonable travel costs and expenses.

Briefs should be provided electronically within 7 days before the mediation.  Exchanging briefs with the other side before mediation is preferred but not required.  If there is some sensitive information a party does not want to disclose to the other side at the outset, please consider whether non-sensitive information can be exchanged, and submitting to the mediator a separate more limited pocket brief containing any sensitive information that the party does not want to initially disclose to the other side. Except in special cases, briefing from a side should not exceed 20 pages total, not including key exhibits.

 

Responsibilities of Fees, Deposits, and Cancellation Policy

 

Unless the parties mutually agree otherwise, all fees and expenses will be split by the parties equally, and counsel shall be billed on behalf of their clients. 

 

Mediation dates will be reserved only upon payment of a deposit equal to 100% of the fee.  

 

Fees are fully refundable if cancellation is made in writing within 30 calendar days of the scheduled mediation.   The parties agree that the cancelling party shall be responsible for any reimbursement of the non-cancelling party’s or parties’ fees.
