After more than 25 years of successfully practicing labor & employment and class action law at one of our country's most elite "big law" law firms, RJ has a keen awarenesses that no case is a "slam dunk."  All cases have risk. When engaged as a mediator, RJ's focus will be to leverage not only his knowledge of the law, extensive trial, litigation and appellate experience, but an equal measure of common sense born out of life lessons learned, to help you resolve your dispute...and get your time back.

Although the firm does not handle litigated cases on a day-to-day basis, "curated legal services" are also offered to complement your existing legal team in cases where RJ will not serve as a mediator, giving you access to a well-developed and unique set of skills, honed over 25 years, pertaining to case evaluation and narrative development, witness preparation for deposition and trial, trial consulting, and other specially tailored services.

DISPUTE RESOLUTION

And even when you "win" every case comes with not only financial costs but -- perhaps even more importantly -- costs in terms of stress and loss of  time to spend time on other pursuits that may matter more. The ability to help people and businesses get their time back is why dispute resolution is the primary focus of the firm. 

When engaged as a mediator RJ will not function as a lawyer advocate representing a particular party against another. Instead RJ's focus will be to leverage his 25 years of extensive trial, litigation, and class action experience, and common sense born of life lessons learned, to help both parties resolve their dispute on their own terms...giving them their time back to refocus their energies on the future and what's important to them.

 

RJ has participated in countless mediations as an advocate with some of the top mediators in the state and country.  He has also participated as a settlement officer in the volunteer dispute resolution program set up by the Los Angeles County Superior Court. RJ received his formal training as a mediator at the prestigious Strauss Institute for Dispute Resolution at Pepperdine University School of Law. In addition to meeting his ethical obligations, RJ commits to three things should you select him as a mediator: 

 

  • He will be prepared.  He will review all materials provided and make sure he’s up to date on the key legal principles before the mediation begins. And if he has questions, he will ask, not assume the answer.

  • He will listen and let the parties be heard.  RJ understands this is your case, not his. While he will generally be an evaluative mediator, ultimately, RJ understands that being heard is an important component to mediation.  RJ will include counsel and the parties in the structure of the mediation to ensure that each side feels the process is transparent, helpful, and fair; anD

  • He will be persistent in the pursuit of resolution.  Only the parties can settle a case.  But both before, during, and after any session, RJ will provide the effort, energy, and focus to get the parties across the finish line, if that’s what they want to do.

Do you see a black chalice? Or perhaps two people, in profile, white, looking at each other?  In litigation, parties often see different things despite looking at the same “facts.”  In cases that go to trial, however, the more important question is what will your jury see?

If your case is lacking focus and direction, RJ will use his formal education in Rhetoric, his unique understanding of the role of “story” and applied cognitive dissonance in juror persuasion, and his 25 years of first chair jury trial experience winning cases others thought were impossible to win, to both assess your case and help you develop a more compelling and effective narrative for trial.  Although RJ does not currently handle litigated cases on a day-to-day basis, curated legal services are offered to complement your existing legal team in cases where RJ will not serve as a mediator, giving you access to a well-developed and unique set of skills, honed over 25 years:
